Baker's Bay Developers Comply 
At the hearing before the Court of Appeal on November 22, the Baker’s Bay Golf & Ocean Club development at Great Guana Cay, Abaco, accepted the view expressed by the Justices that the issues raised by the landowners of Great Guana Cay should be decided on merit and not dismissed solely on the ground that the applicant was a company rather than the landowners themselves.
The Court of Appeal gave the landowners permission to become applicants personally in order for the application to proceed. They directed that the action be heard by a judge of the Supreme Court before January 31, 2006.
Pending a determination by the Supreme Court, the Baker’s Bay developers voluntarily undertook not to:
1. Cut, tear down or remove any vegetation or trees;
2. Disturb or remove any mangrove or wetlands;
3. Excavate or dredge the land or seabed;
4. Erect any further buildings or structures on the land;
5. Construct or pave any further roads.
“These undertakings demonstrate the continued commitment of Baker’s Bay to the judicial process and to the environment”, said Dr. Livingston Marshall Jr, senior vice president for environmental & community affairs at Baker’s Bay.
“We remain confident that the project will proceed to a successful and timely completion. The Baker’s Bay project has always complied with the laws of the Bahamas, and in particular, all works carried out by the project to date have been in complete compliance with the laws of the Bahamas.”
Baker’s Bay Golf & Ocean Club is a $500 million planned development at the Northern end of Great Guana Cay and currently employs 151 Bahamians.
